1) Your offer to purchase goods, merchandise, products and/or services from The Maple Ridge Bamboo Store Limited DBA The Bamboo Store, is accepted only upon the terms and conditions stated below. Any additional or different terms and conditions proposed by you the customer are not accepted and shall have no effect on these terms and conditions.

2) Payment for shipping and goods or /product is due upon order completion in full (100%) and must be received prior to merchandise leaving warehouse location.

3) All sales are final. All products are sold as is. The Bamboo Store cannot assume responsibility for products improperly or incorrectly ordered. Incorrectly ordered products cannot be returned without approval. All returns shall have freight and any other related costs including customs clearance and brokerage prepaid by the customer from the return point of origin. Returned product is not to be sent COD. It is the financial responsibility of the customer. Product must be new and in re-sellable condition. In the same packaging and same condition it was sold and sent in. There will be a 20 percent (20%) restocking fee on any product that is returned. All shipping, courier and freight charges are 100% non-refundable.

4) Products are shipped via Purolator, Fed Ex Ground, local or national freight courier. All shipping charges will be the responsibility of the customer unless otherwise stipulated. The Bamboo Store order turnaround time is usually 1 – 3 business days after order completion and payment has been received in full period before shipment is made. The Bamboo Store tries to ensure for the quickest transit times of generally 2-7 business days within Canada, however delivery within fifteen (15) days of completed order is considered reasonable and acceptable.  The Bamboo Store is not to be held responsible or liable for disruption in delivery service or failure of performance due to conditions or events beyond its control including natural disasters, accidents, labor disputes, shortages, customs, rules and regulations and inability to obtain material, equipment or transportation etc.

5) The risk of loss to the goods subject to this agreement shall pass to you as soon as such goods are presented to a carrier for delivery to you. Releasing The Bamboo Store from any liability to damage that has occurred during transit. The Bamboo Store cannot be held liable for damage or loss of shipment by a freight carrier. Should damage or loss occur during transit, it is the responsibility of the customer to address the issue with freight courier.

6) Your receipt of any goods shall be deemed as acceptance of them and void any and all claims not made in writing to The Bamboo Store within three (3) business days after receipt and or delivery of goods.  Defect of part of the product or merchandise or product shall not be considered grounds for rejection by you the Buyer, of all merchandise, or the entire particular item in which the defect is found, nor shall be grounds for the termination or cancellation of the undelivered portions or orders.

7) Bamboo is a natural wood-like product and subject to cracking, splitting and discoloration, this does not affect its structural integrity. Bamboo is unique and will vary in size, shape and color. All bamboo is expected to be within +/- 10-20% of the range diameter it is sold in. Bamboo is flammable. It is recommended that all bamboo used outdoors is to be treated, painted and or sealed to protect for environmental elements such as UV rays, wind, rain, snow, fungus, mildew and mold etc. Bamboo left untreated will turn a dark blackish grey colour with the high possibility of mold and fungus growth on it. Please speak to someone at your local hardware or paint store. The Bamboo Store does not endorse, support or recommend any particular brand or product to use on bamboo.

8) This agreement is to be interpreted according to Provincial Law in the Province of British Columbia, Canada. Any legal proceeding arising from or relating to this agreement shall be held exclusively in Vancouver, BC, Canada. The prevailing party to any legal dispute arising from, or related to, this Agreement shall be entitled to a complete recovery of legal fees and costs.

9) Products listed as "Free Shipping" applies only to shipping addresses that are located within Canada.

10) The Bamboo Store makes no claims, whether it be implied or express regarding representation and warranty in regards to the goods and products described for sale, including without limitation, representation and warranty regarding use and performance, manufacture, structure, warranty and design of any such product or any implied warranty. The Bamboo Store’s total responsibility and liability for cost, loss, damage or other potential or actual expense directly or indirectly out of the purchase and sale of the goods, regardless of the action, contract or otherwise, shall not exceed the purchase price paid by you the buyer for the goods. In no way will The Bamboo Store be held liable or accountable in any way for any consequential or special damage even if The Bamboo Store is informed or is made aware otherwise or should be aware of their likelihood.
